Services

The Arnett Law is focused on professional, quality services for individuals with assets that need to plan their estate wishes and tax consequences or have estate administration needs after the loss of a loved-one. We pride ourselves on the individualized services we provide for our clients.   

Our firm provides services depending upon the client’s desired level of services. Unless otherwise noted, our services will be charged on a hourly basis. However, rates may vary depending on the type of project involved.  Certain of our services lend themselves to a fixed fee. 

A fixed fee for estate planning services generally includes an initial consultation of one and a half hours, the initial document preparation, one set of revisions, a one-hour review meeting, and a lawyer supervised notarization signing ceremony. Any additional services will be charged at the standard hourly rate.  Half of fixed fee is due prior to document preparation.  Unless otherwise arranged, the balance of the fixed fees are due at time of completion of the service or delivery of the documents for review, whichever comes first.

Probate estate administration services are always serviced at our standard hourly rate because it is impossible to project the depth of services needed on a particular estate. 

Our standard hourly rates may change due to the length of time over which the services are rendered or due to a change in circumstances or the type of project involved.  Our standard hourly rates are available upon request for each service listed herein below.  Not all estate and business packages will contain the same services. 

A. Estate Planning

Revocable Living Trust

This package may include a Revocable Living Trust, Pour Over Will, General Power of Attorney, Advance Medical Directive/Medical Power of Attorney,  Tangible Personal Property Directive, Certification of Trust, Trust Funding Assistance, and a HIPAA Authorization. Prices vary depending on whether the individual is single or married and what documents are included.

Total Trust Funding

This is an add-on to any of our estate package includes Trust Funding Assistance.  Our Total Trust Funding is highly recommended to ensure proper trust funding. The total trust funding fee can be avoided by funding your own trust.

Estate Plan Protection

Annual Charge for updates to Estate Planning documents due to changes in the law or personal circumstances, and an bi-annual re-signing of Power Of Attorney and Advance Directive.

Lifetime Protection

 

 

After the first year, this annual fee provides ongoing lifetime protection. It includes consultations between you and our firm as necessary to carry out your Estate Plan and Asset Protection Plan consistent with your needs and desires. As part of this annual fee, we will modify your documents as necessary due to changes in the law, family or financial circumstances, changes of address, or changes in your wishes.

Basic Will

This service includes: Standard Will, General Durable Power of Attorney with power of attorney for real estate, Advance Medical Directive or Durable Medical Power of Attorney with living will and HIPAA release authorization.

Power of Attorney

This service includes: Financial Durable Power of Attorney with power of attorney for real estate, and Advance Medical Directive or Durable Medical Power of Attorney with living will and HIPAA Authorization.

B. Business Planning

Incorporation

This service includes Articles of Incorporation, Bylaws, Minutes of First Organizational meeting, Application for Employer Identification Number (“EIN”), and Advisory letter.

Complete Incorporation

This service includes Articles of Incorporation, Bylaws, Minutes of Organizational meeting, Shareholders Agreement/Buy Sell Agreement, Application for EIN, and Advisory letter.

Tax Exempt Nonprofit Incorporation

This service includes Articles of Incorporation, Bylaws, Minutes of Organizational meeting, Application for Employer Identification Number ("EIN") and Advisory letter.

Tax Exempt Nonprofit Complete Incorporation

This service includes Articles of Incorporation, Bylaws, Minutes of Organizational meeting, Application for Employer Identification Number ("EIN"), Advisory letter, Application for Recognition Exemption under 501(c)(3) with the Internal Revenue Service (“IRS”) code to receive tax exempt status by the IRS and Maryland. 

LLC or Limited Liability Partnership (LLP) Organization

This service includes Articles of Organization, Lease Addendum (transferring lessor responsibility to the LLC), Operating Agreement that stipulates the entire life of the organization and its dealings with the other partners and termination, if any, as well as coverage of disassociation of any of its members, Application for EIN, and Advisory Letter.

Deed for Transfer of Real Estate into Trust or Business Entity

Fixed fees do not include county or state recording or delivery charges.
